Knight Institute Executive Director Jameel Jaffer appeared on The Mehdi Hasan Show last week to discuss the Espionage Act and its application in former President Trump’s indictment.
Jaffer tells Hasan, “Nobody ever said that the Espionage Act was unconstitutional in every application. The argument has always been that the act is unconstitutional as applied to publishers and whistleblowers. Nobody ever suggested that the government couldn’t constitutionally use the Espionage Act against somebody who shared classified information with a foreign government in order to harm the United States. That’s the whole point of the Espionage Act. Everyone’s on board with that. And I think the allegations against Trump are much more like that than they are like allegations against whistleblowers.”
