Nomination of Sitting Member of Congress to Be Ambassador to Vietnam
The Ineligibility Clause does not bar the nomination of Representative Pete Peterson to be Ambassador to the Socialist Republic of Congress, provided that the President does not make the determination to create the office of ambassador to that government until after the expiration of the term for which Representative Peterson was elected. The OLC does not provide release dates for its opinions, so the release date listed is the date on which the opinion was authored.
